Employers have an overarching duty under work health and safety legislation to provide and maintain, so far as is reasonably practicable, a working environment that is safe and without risks to health. Central to this duty is ensuring that employees are fit to attend work.

Where employees have physical and/or psychological conditions, this may impact their ability to perform work safely, potentially giving rise to an exacerbation of the condition and/or further injury. Additionally, this can in turn have a significant impact on other workers, duty of care, productivity and your business’ bottom line. It is therefore crucial to ensure that throughout the course of employment employees are fit to fulfil the inherent requirements of the role they are applying for, this includes:

  • As a key element of pre-employment processes.
  • Routinely throughout employment.
  • In response to personal and work-related injuries, conditions and illnesses.
  • During key life transitions such as becoming a parent and transition to retirement.

  • Understand how WHS, Workers’ Compensation, and equal opportunity laws each impact on issues associated with fitness for work throughout the employment spectrum.
  • Consider the types of issues that can impact on fitness for work, both work related and outside of work.
  • Understand what is meant by “the inherent requirements” of a position.
  • Implement employers’ rights to assess fitness for work.
  • Understand how to have conversations that generate the best outcome for the employee and the business.
  • Identify and implement meaningful reasonable adjustments to support capacity and wellbeing.
  • Consider what to include in workplace contracts, policies and procedures.
