From 1 December 2025, the Occupational Health and Safety (Psychological Health) Regulations 2025 (‘Regulations‘) and Compliance Code will come into effect in Victoria.
The Regulations will require employers in Victoria to identify psychosocial hazards and control the associated risks, so far as is reasonably practicable. While these obligations appear new, the duty to proactively manage psychosocial risks already exist under the Occupational Health and Safety Act 2004 (Vic). The new Regulations, however, bring added clarity and expectations of compliance, and align with regulations introduced in other Australian states and territories.
In light of these upcoming changes, it is now more important than ever for employers to ensure their systems, policies and training are aligned with the updated legal framework and more stringent reporting requirements.
