How to Conduct Workplace Investigations While Mitigating Psychosocial Risks

Description

Event Details

24 June 2026, 12:00 pm - 1:00 pm

Workplace investigations are often necessary, but they can also create or amplify psychosocial risks if not planned and managed carefully. Poorly handled processes can lead to heightened conflict, compromised wellbeing, increased absence, and in some cases psychological injury claims and regulatory scrutiny.

In this practical joint webinar, Dan Feldman, Partner at HR Legal, together with Rob Cockerell, former Detective Chief Inspector at Victoria Police and now Director of Forensic & Integrity Solutions, and Geoff Peck, former Detective Sergeant with Victoria Police’s Major Fraud Group and now Director of Forensic & Integrity Solutions, will explore how to run lawful, defensible and procedurally fair investigations while taking a proactive approach to psychosocial safety.

What you’ll learn

We will cover how to conduct investigations with a psychosocial lens, including:

  • Why conduct an investigation?
  • When should an investigation occur?
  • Key considerations when investigating: including identifying psychosocial hazards that may be contributing to the complaint, and considering systematic risk alongside individual conduct
  • Choosing the right pathway: internal vs external investigators
  • Designing an investigation plan that reduces harm
  • Conducting a psychosocially safe investigation process: how to plan and conduct interviews that are robust and fair, while managing distress, conflict and psychological safety
  • Understanding behaviour in interviews: how body language and credibility indicators may present in stressful workplace investigations and how to avoid common misinterpretations
  • Understanding deception (carefully and appropriately): what to look for, what not to assume, and why process and evidence matter more than “gut feel”
  • Legal risks before, during and after: additional matters and legal risks to consider before, during and after workplace investigations
