There have been recent changes to child safety laws impacting education and childcare services both at a National and Victorian level. Specifically, these reforms are designed to improve the safety, wellbeing, and protection of children in the education and childcare sector, enhance regulatory oversight, and improve professional standards across the sector.
In Victoria, the Child Wellbeing and Safety Act 2005 (Vic) (Act), Child Safe Standards and Reportable Conduct Scheme apply in addition to the applied law system to provide an essential framework to ensure comprehensive and applicable regulations to ensure the safety of children and compliance standards in Victoria.
Failure to meet the minimum requirements under the child safety laws may expose organisations to significant legal and reputational risk, including civil penalties. More importantly, noncompliance compromises the safety and wellbeing of children and young people in the organisation’s care. A key component of compliance is ensuring that leaders, managers, people and culture, and other staff and volunteers understand and uphold their obligations under child safety laws.
